The Union of Free Trade Unions of Montenegro submitted the Initiative for Amendments to the Law on the Labor Fund due to the fact that in the transition period a number of employees were deprived of the payment of contributions for pension and disability insurance. During this period, in accordance with legal regulations, the payment of taxes and contributions for pension and disability insurance, both at the expense of the employer and at the expense of the employee, was the exclusive obligation of the employer. Also, in accordance with legal regulations, the obligation to monitor and supervise the payment of contributions for pension and disability insurance had authorized state institutions, which, however, did not perform adequate supervision, which is why a number of employees were put in a situation where they could not meet the conditions for retirement because they have not been paid pension and disability insurance contributions. This is especially problematic for employees whose employer has ceased to exist.
With this Initiative, the UFTUM demands that the state take responsibility for the lack of action of its institutions and compensate employees who, through no fault of their own, are prevented from exercising their right to a pension.
